What is the penalty for not returning a deposit in North Carolina?

Short answer

Forfeiture of the right to withhold any portion of the deposit if the landlord fails to comply with NCGS 42-52. The penalty is in addition to the wrongfully withheld deposit itself. North Carolina courts routinely hear deposit disputes in small-claims court, where landlords who missed the 60-day deadline without written explanation face a presumption of bad faith.
