North Carolinaยท Answer

How much can a North Carolina landlord charge as a security deposit?

Short answer

In North Carolina, the total security deposit cap is 2 weeks week-to-week, 1.5 months month-to-month, or 2 months for longer terms under NCGS 42-51. Refundable deposits (security, cleaning, pet, key) all count toward the cap. Non-refundable fees (application fees, clearly labeled non-refundable cleaning fees) are not counted. NCGS 42-51 caps deposits at 1.5 months for month-to-month, 2 months for longer tenancies, 2 weeks for week-to-week. When the tenancy ends, the landlord must return the deposit within 60 days with an itemized statement of any deductions, under NCGS 42-52.

Honest limits

This is an informational answer based on NCGS 42-52 as of early 2026. It is not legal advice. Housing law changes year to year and local ordinances (especially in rent-controlled or rent-stabilized cities) can override or add to state law. For contested cases, consult a North Carolina-licensed attorney.
