Texasยท Answer

How many days pay-or-quit notice does Texas require?

Short answer

Texas requires 3 days under Tex. Prop. Code 24.005, unless the lease specifies longer. The notice period starts the day after service. The notice must be written and include the amount of rent due, the deadline, the property address, and the landlord's signature. Serving by personal delivery, certified mail, or posting (where state law allows) counts as valid service. An incorrectly drafted or served notice voids the subsequent eviction.

Honest limits

This is an informational answer based on Texas eviction statute as of early 2026. It is not legal advice. Housing law changes year to year and local ordinances (especially in rent-controlled or rent-stabilized cities) can override or add to state law. For contested cases, consult a Texas-licensed attorney.
