Does a Illinois notice to quit need to be notarized?
No. Illinois notices to quit do not require notarization to be valid. The landlord (or agent) signs the notice; that signature, plus proper service, is what gives the notice legal effect. Notarization is sometimes used as evidence of authenticity in contested cases, but it is never a statutory prerequisite. What does need to be precise: the tenant's full name, the property address, the violation or amount owed, the cure period (5 days for pay-or-quit under 735 ILCS 5/9-209, 10 days for violations under 5/9-210), the consequence of non-compliance, and the landlord's signature and date. Errors in any of these elements are a more common cause of dismissed cases than the absence of a notary stamp.
