Can a Florida landlord raise rent at any time?

Short answer

No. A Florida landlord cannot raise rent during a fixed-term lease (unless the lease itself provides for it). On a month-to-month tenancy or after a fixed term expires, the landlord may raise rent with the required advance written notice. Florida has no statewide advance notice for rent increases. Fla. Stat. 83.57 (post-HB 1417, effective July 1, 2023) requires 30 days notice to terminate a month-to-month tenancy, which landlords use as the default for rent changes. No state rent cap. Any increase served without the correct notice period, or that exceeds the applicable cap, is void.
