Minimum statutory notice
3 days
California requires 3-day pay-or-quit notice before an eviction can be filed for non-payment of rent.
Cal. Civ. Code §§ 1940-1954; Civ. Code § 1950.5
Why notice periods matter
If the notice period is too short, the tenant can raise it as a defense in the eviction hearing and the landlord has to start the clock over. An extra week of lost rent plus filing fees. The statute is specific to the type of notice and often scales by tenure length or the reason for termination.
